Eric Holder, U.S. attorney general, gives a speech today on why the President has the "right" to murder Americans without due process that was guaranteed to us by the bill of Rights. Those same Rights that all those in the government swear to uphold and defend. So, if they break that oath, are we obligated to obey anything they command? Don't they give up the Right to govern when they break their oath to us? Aren't we supposed to be the ones who consent to be governed, and on the basis that our Rights are not to be infringed upon?
Is this government legitimate?

The
people cannot delegate to government the power to do anything which
would be unlawful for them to do themselves. ... whenever the
Legislators endeavor to take away, and destroy the Property of the
People, or to reduce them to Slavery under Arbitrary Power, they put
themselves into a state of War with the People, who are thereupon
absolved from any farther Obedience, and are left to the common Refuge,
which God hath provided for all Men, against Force and Violence. John Locke
